摘 要
隨著封建經濟的不斷完善和發展，奴隸制殘酷野蠻的肉刑制度越來越不適應社會的客觀要求，於是漢代的刑罰制度在承用秦制的基礎上改革創新，尤其是在漢文帝、漢景帝刑制改革前後刑罰體系發生了很大的變化，也形成了1些儒家化的'刑罰適用原則。這1刑制的改革，在中國法制史上意義重大，他是中國古代刑制由野蠻階段進入較為文明階段的轉折點。這1改革更加適應了封建經濟基礎的要求，同時為封建刑制向新“5刑”的過度奠定了基礎。本文從法學和史學的角度對我國漢代刑罰改革進行述評，試圖分析其產生的原因背景、歷史地位、取得的社會效能及存在的弊端方面，以資當今社會主義法制建設之借鑑。
